Abstract

This article denies that the current recourse of unification of jurisprudence must be understood as a mechanism that incorporates to the Chilean legislation the judicial precedent, as being contrary to the proper postulates of a traditional rule of law state. lts reason rests on a dogmatic-politic premise, that is, the content of the constitutional provisions must be set by rules, made by political deliberation, and not left to an elite group as it is the Supreme Court, at the cost of appropriating a strictly political discussion. This appropriation, combined with a mechanism of binding precedent, would let the judge in a situation comparable to that of the legislature.
